The ice we had Tuesday got my sister, her new Honda is at the dealer now. Looks like we will have more tonight and tomorrow.

Just when I thought this was over. Yesterday I get an invoice in the mail from the Ohio Dept of Transportation for replacement of two 12.5 ft sections of major guardrail and one 12.5 minor section -- total cost (drumroll please) of $1498.15. They obviously don't know that an x90 is the size of a matchbox car. Fun just never ends...

Tell them it was already f-ed up! I can rub some black paint on it. I would report that to insurance now. And press some charges later.

Thats total BS! That kind of stuff pisses me off. Let me get this right your suzuki could be repaired but 37ft of guardrail was destroyed:confused:

I'd be mad but it's just so comical, that I can't stop chuckling. My cute little purple car (that is slightly larger than a golf cart w/all of 100 hp) drove away from the scene...but apparently left a 37 foot path of devastated guardrail in it's wake. Still funny...

I ran a side-swiped a guardrail with a motorcycle once. Didn't hardly leave any paint on it, let alone a scratch or dent. Same thing happened. About 6 months later, I get a bill for a guardrail replacement. I think they must replace it if it gets hit by anything, doesn't make any sense to me. I considered it case closed long before this bill. But the insurance company picked it up with no questions asked. I'd just let them worry about it.

That's what everyone says ... insurance company. So I'm the only person in the world that decided not to file a claim on an accident. Who knew?

Dont file with insurance until your last hope... the premium hike you will receive is not worth just paying for the guardrails.

I wouldn't pay this til they dragged my ass thru court to make me do it. The police report says "no damage." You and other witnesses (im sure your rescuers would testify for you) saw no damage. There is no way your little car could even begin to destroy 37 feet of guardrail without your little x90 being in about 37 pieces itself. I would make them prove you messed the guardrail up, either with photos or some kind of documentation of such.

If they say they repaired it, make them produce the old destroyed guardrail as proof, and require they give it to you if you have to pay, since you are paying for the guardrails you messed up. Trust me, if you fight this, you won't have to pay. They send a guardrail bill to every motorist that got near one in an accident. It's a serious revenue maker for them. They know that most people will submit it to insurance, and that insurance will pay it.

Send a copy of your police report with "no damage" hilited along with the bill to the address required. Go from there.

Yea I talked to the nice lady in accounting at the state late yesterday, who of course can't actually negate the invoice. I started out saying that my copy of the accident report says 'no damage' so I was confused. She said her copy was a generic report, and she saw that notation on the other one when she pulled it. Then said I also drove the car away, to which she said the report says a trailer. I said I didn't know if I should drive it, as I'm not a mechanic. When they with a trailer arrived; they said it could. Then said this car is just slightly bigger than a golf cart. After a few minutes of chit chat, she says something about me taking out 50 ft of guardrail and posts, then driving it away sounding unrealistic. I very calmly agreed. Then there was something from her about this process having a few holes. To which I didn't reply, as I had nothing nice to say. She said she'll turn it over to someone to review it and make the determination that I didn't mangle the guardrail and leave the scene. I sent her the pic from the front of the x90 to her (you know the one that didn't show much damage) to forward to him. Should hear from him next week, hopefully. I also drove by before the TS meeting and saw the pretty new guardrail in place as well. :rolleyes:

After all this I've learned a few things: one not everyone showing up at the side of the road when you're in "trouble" is there to help you (may not be a steak knife, but you're gonna get stabbed somehow). two if there is no paperwork, it never happened. three never stay there.

My insurance will not raise my rates unless it is a $20,000.00 claim I was told in writing. You may want to check because it could save you a bunch of time.

Scott P, you were lucky the farmer didn't come after you for having trailer drags in his fields and messin up all that corn. And i'm sure we could have pulled DNA from your front seat.

Well my guess is I get stuck with this stupid thing. State guy will meet me there tomorrow afternoon to look at the section I hit (that still shows purple paint on it, next to the yellow from the vette that hit after me). Figure I'll also take along the police report that says no damage....then call Allstate afterward. Not really feeling like this is gonna go my way at this point. I could just about spit nails at this point on the whole subject. More to come...

Ok funny story...Allstate says they wouldn't pay a claim anyway because the police report clearly no damage to guardrail. So I'm gonna try square two, and go from there. Calling nice man back to say I'm not going to meet him since my police report says it wasn't my accident that damaged it. Once again...ongoing saga to be continued

No one was hurt and when this is all over you will still be able to walk and smile.
No matter what there is still a bright side to this.

Yes, It sucks huge donkey dongs but it will pass.
Head up and Smile. You will not know what will happen until it happens.
Your insurance might have more luck fighting this then you if you have to file.

untill then watch out for low flying suzuki x90s they pack one heck of a punch for such a small car and also if they do that much damage to guardrail in milford dont expect that guardrail to save you because it must be made of aluminum foil
